The general terms and conditions apply to all our products and services:
Article 1. Applicability
1.1 These General Terms and Conditions of Sale (hereinafter: Conditions) apply exclusively to all offers, orders and agreements of Abouthome.nl (hereinafter: About Home), to the exclusion of any other general terms and conditions.
1.2 Accepting an offer or placing an order implies that you accept the applicability of these Conditions.
1.3 Deviations from the provisions in these Conditions can only be made in writing, in which case the remaining provisions remain fully in force.
1.4 All rights and claims, as stipulated in these Conditions and in any further agreements for the benefit of About Home, are equally stipulated for the benefit of intermediaries and other third parties engaged by About Home.
Article 2. Offers/agreements
2.1 All offers from About Home are without obligation and About Home expressly reserves the right to change prices, in particular when this is necessary on the basis of (legal) regulations. See also article 3.6.
2.2 An agreement is only concluded after About Home has accepted your order. About Home is entitled to refuse orders or to attach certain conditions to the delivery, unless expressly stated otherwise. If an order is not accepted, About Home will notify this within ten (10) working days after receipt of the order.
Article 3. Prices and payments
3.1 The stated prices for the products and services offered are in euros, including VAT and excluding handling and shipping costs, any taxes or other levies, unless stated otherwise or agreed in writing.
3.2 Payment can be made in the manner(s) indicated during the ordering process. Further (payment/order) conditions may be set for your order. In case of payment by bank or giro, the date of payment is the date of crediting the giro or bank account of About Home.
3.3 If the payment term is exceeded, you will be in default from the day on which payment should have taken place and you will owe a delay interest of 1% per month or part of a month on the outstanding amount from that day. If payment takes place after a reminder, you will owe an amount of three euros and fifty cents (€ 3.50) in administration costs and if About Home outsources its claim for collection, you will also owe the collection costs, which are at least fifteen percent (15) of the outstanding amount, without prejudice to About Home's authority to claim the actual extrajudicial collection costs instead.
3.4 If you are in default with any payment, About Home is entitled to suspend or dissolve (the execution of) the relevant agreement and related agreements.
3.5 If the prices for the products and services offered increase in the period between the order and its execution, you are entitled to cancel the order or dissolve the agreement within ten (10) days after notification of the price increase by About Home.
3.6 About Home is not liable for any typing errors with regard to prices
Article 4. Delivery
4.1 The delivery times stated by About Home are indicative only. Exceeding any delivery term does not entitle you to compensation and also not the right to cancel your order or dissolve the agreement, unless the exceeding of the delivery term is such that you cannot reasonably be expected to maintain the agreement. In that case, you are entitled to cancel the order or dissolve the agreement insofar as necessary.
4.2 The delivery of the products takes place at the place and time at which the products are ready for shipment to you.
Article 5. Retention of title
5.1 The ownership of delivered products only passes if you have paid everything you owe About Home on the basis of any agreement. The risk with regard to the products already passes to you at the time of delivery.
Article 6. Intellectual and industrial property rights
6.1 You must fully and unconditionally respect all intellectual and industrial property rights resting on the products supplied by About Home.
6.2 About Home does not guarantee that the products delivered to you do not infringe any (unwritten) intellectual and/or industrial property right of third parties.
Article 7. Complaints, promotions, offers and liability
7.1 You are obliged to examine upon delivery whether the products comply with the agreement. If this is not the case, you must notify About Home of this as soon as possible and in any case within fourteen (14) working days after delivery, or at least after detection was reasonably possible, in writing and with reasons.
7.2 If it has been shown that the products do not comply with the agreement, About Home has the choice to replace the relevant products by returning them with new products or to refund their invoice value.
7.3 If you do not wish to purchase a product for any reason, you have the right to return the product to About Home within fourteen (14) working days after delivery. In this case, returns are only accepted if the packaging of the product is undamaged and the plastic seal on the packaging has not been broken, and the costs for return shipments are for your account.
7.4 If you have made use of a promotion or offer offered by About Home, this only applies if you meet the conditions of this promotion or offer. If you return your product, the promotion or offer will expire. Only the purchase amount paid by you will be refunded to your account number.
Article 8. Orders/communication
8.1 About Home is not liable for misunderstandings, mutilations, delays or improper transmission of orders and communications as a result of the use of the Internet or any other means of communication in the traffic between you and About Home, or between About Home and third parties, insofar as related to the relationship between you and About Home.
Article 9. Force majeure
9.1 Without prejudice to its other rights, in case of force majeure About Home has the right, at its own discretion, to suspend the execution of your order, or to dissolve the agreement without judicial intervention, by notifying you of this in writing and without About Home being obliged to pay any compensation, unless this would be unacceptable in the given circumstances according to standards of reasonableness and fairness.
9.2 Force majeure means any shortcoming that cannot be attributed to About Home, because it is not due to its fault and is not for its account by virtue of law, legal act or generally accepted views.
Article 10. Miscellaneous
10.1 If you provide About Home with an address in writing, About Home is entitled to send all orders to that address, unless you provide About Home with a different address in writing to which your orders should be sent.
10.2 If About Home allows deviations from these Conditions, tacitly or otherwise, for a short or long period, this does not affect its right to still demand immediate and strict compliance with these Conditions. You can never assert any right on the basis of the fact that About Home applies these Conditions flexibly.
10.3 If one or more of the provisions of these Conditions or any other agreement with TD1813 should conflict with any applicable legal provision, the provision in question will lapse and will be replaced by a new legally permissible comparable provision to be determined by About Home.
10.4 About Home is authorized to use third parties in the execution of your order(s).
Article 11. Applicable law and competent court
11.1 All rights, obligations, offers, orders and agreements to which these Conditions apply, as well as these Conditions, are exclusively governed by Dutch law.
11.2 All disputes between parties will be exclusively submitted to the competent court in the Netherlands.
